1. Acceptance of terms
By accessing and using the platform bearspreadwt.com, operated by Bearspreadwt S.R.L. (NIT 1023456789), you agree to comply with these Terms and Conditions. If you disagree with any provision, we ask that you do not use the platform. Continued use of the service constitutes your acceptance of any future modifications to these terms.
2. Definitions
In these terms: 'Platform' refers to the website bearspreadwt.com and all its associated services; 'User' is any person who accesses or uses the platform; 'Real estate crowdlending' refers to the collective financing model applied to real estate projects; 'Project' is any real estate investment opportunity presented on the platform; 'Participation' is the user's economic contribution to a specific project.
3. Service description
Bearspreadwt operates a digital real estate crowdlending platform that facilitates the connection between real estate projects and people interested in participating in their financing. The platform provides information about available projects, enables participation management, and offers tracking tools. Bearspreadwt acts as a technological intermediary and does not guarantee the results of published projects.
4. Eligibility requirements
To use the platform you must: be at least 18 years old; have legal capacity to enter into contracts under Bolivian law; provide truthful and up-to-date information during registration; and reside in a jurisdiction where real estate crowdlending is not prohibited. Bearspreadwt reserves the right to verify compliance with these requirements.
5. Registration and user account
Registration on the platform requires providing truthful personal data. The user is responsible for maintaining the confidentiality of their access credentials and all activities carried out from their account. You must immediately notify us of any unauthorized use of your account. Bearspreadwt will not be liable for losses arising from unauthorized use of your account when such use is attributable to your negligence.
6. Acceptable use of the platform
You agree to use the platform lawfully and in accordance with these terms. It is prohibited to: use the platform for illegal or fraudulent activities; attempt to access restricted areas of the system; interfere with the normal operation of the platform; impersonate another person; and reproduce, distribute, or modify platform content without express authorization.
7. Intellectual property
All platform content, including texts, graphics, logos, images, software, and its design, is the property of Bearspreadwt S.R.L. or its licensors and is protected by the intellectual property laws of the Plurinational State of Bolivia and applicable international treaties. The user is granted a limited, non-exclusive, and revocable license to access and use the platform for personal and non-commercial purposes.
8. Limitation of liability
The platform is provided 'as is' and 'as available.' Bearspreadwt does not guarantee that the service will be uninterrupted, error-free, or completely secure. To the maximum extent permitted by Bolivian law, Bearspreadwt shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the platform.
9. Indemnification
You agree to indemnify and hold harmless Bearspreadwt S.R.L., its directors, employees, and agents from any claim, liability, damage, or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the platform, or your violation of third-party rights.
10. Governing law and jurisdiction
These terms are governed by the laws of the Plurinational State of Bolivia. Any dispute arising from these terms or the use of the platform shall be submitted to the jurisdiction of the competent courts of the city of La Paz, Bolivia, with the parties waiving any other jurisdiction that may apply to them.
11. Modifications
Bearspreadwt reserves the right to modify these Terms and Conditions at any time. Modifications will take effect from their publication on the platform. It is the user's responsibility to periodically review these terms. Continued use of the platform after publication of changes constitutes acceptance of the modified terms.
